Kitwe Chief Resident Magistrate Yvonne Nalomba has committed libikani Phiri and other 18 members of the infamous gang popularly known as the Tokota Boys to the High Court for summary trial.
This happened yesterday when the case came up for mention where Magistrate Ms Nalomba committed the 18 to the Kitwe High Court for trial in the offense of three counts.
Allegations are that on April 30, this year the 19 jointly and whilst acting together with intent to maim, injure or disfigure caused harm to Cuthbert Nkonde.
In count two the 19 are accused with unlawful wounding and poisoning contrary to the Laws of Zambia.
And in the last count they accused are charged with abducting or kidnapping of a 16-year-old boy.
Magistrate Ms Nalomba said that this was in accordance with the Director of Public Prosecution’s instructions committal certificate.
Meanwhile, three members of the ‘Tokota Boys’ who pleaded not guilty to committing rape appeared in the Kitwe Magistrate court.
The three members of the Tokota gang namely Richard Siame 21, Teddy Chilufya and Chris Kalenga both 20, are each facing one count of rape contrary to the Laws of Zambia.
Two out of the three are charged together with the 19 boys who have been committed to the high court.
Particulars of the offence are that the three, on February 2, this year in Kitwe had unlawful carnal knowledge of a named minor without her consent.
Three witness testified in the case which included the victim who narrated what transpired on the material day.
The named minor informed the court that on February 2, this year around 23:00 hours in the night she went out with her friends to a night club called Shuttles in Nkana West.
She narrated that when they arrived at the night club her friends proceeded inside the club while she remained behind making a call.
While she was making a call she was approached by six guys one of them was the gang leader May Weather who wore T-shirts with words written “pay or die” on them who asked her if she needed a taxi.
“Then my friends joined me. We were then told to drive the “Tokota” Boys to Ndeke by their leader May Weather. We obliged.
“May Weather then asked my friends who was driving the car to stop the car at an unfinished building demanding that I remove my clothes. I refused but May Weather then started slapping me and forced himself on her,” she said.
She said thereafter the six guys took turns to rape her leaving her unconscious.
Magistrate Ms Nalomba then adjourned the case to July 17, this year for continuation of trial.
May Weather and the other member by the name of Gucci are still at large.
The victim identified only three on the identification police parade.
