Three losing contenders of the Lumezi Parliamentary Election have asked the Constitutional Court to reverse the Chipata High Court’s judgment that validated Munir Zulu as the victor in the race.
These are Getrude Pilila Jere of the PF, UPND’s Macdonald Phiri and Zelipa Chitsulo who was an independent candidate.
In the Memorandum of Appeal out of time, Ms Jere has contended that the High Court erred in law by ruling that there was no evidence that Mr Zulu was or his agents were involved in the donation of some materials to woo voters.
Ms Jere also alleged that Mr Zulu does not possess the requisite Grade 12 Certificate to have warranted his participation in the race as stipulated by article 72 of the Zambian Constitution.
The Memorandum of Appeal out of time was filed pursuant to Order 15 rule 7 of the Constitutional Court Rule 7 Statutory Instrument Number 37 of 2016.
On November 21, 2021, the Chipata High declared Mr Zulu as duly elected Lumezi independent Member of Parliament.
