The Chingola Magistrate Court has convicted a-51-year-old man of Lulamba Township for sexual defilement and he has been committed to Kitwe High Court for sentencing.
This is in a matter in which Willy Ekeleni of Lulamba was facing one count of sexual defilement contrary to the Laws of Zambia.
Particulars of the offence are that on June 19, 2020 Ekeleni willfully but unlawfully had canal knowledge of a girl under the age of 16.
When the matter came for trial the victim told Chingola Resident Magistrate Stephen Mabona that on the fateful day she was sent by her mother to her elder sister’s place who was unwell.
And on her way back around 19:00 as she was going home, she met Ekeleni who dragged her inside the vehicle and drove to a place where there were no houses.
The victim also told the court that he packed the vehicle and grabbed her to the front sit, undressed her and then had canal knowledge of her.
She also told the court that he told her that he will only take her home after she stops crying.
Sadly, police on patrol had spotted the car parked suspiciously and they went to check.
They patrolling officers found Ekeleni had just finished known the juvenile but they took both and that’s how revelations were made.
In passing Judgement Magistrate Mabona said that the prosecutions has proved beyond doubt that the victim was a child below the age of 16 and that she was found inside the vehicle of the accused around 22:30 packed at an area far from houses at a later hour.
He said that the victim’s evidence was collaborating with other evidence in court that when the police sported a suspicious car parked along the road found the victim inside the car crying.
Mr Mabona said he found the accused guilty and convicted him accordingly.
He later committed him to the Kitwe High Courts for mitigation and sentencing.
