Luanshya father jailed for assaulting son

The Luanshya magistrate court has convicted and sentenced a -28-year old man of freedom compound in Luanshya district to Six-years imprisonment with hard Labour for assaulting his four-year old son.

This is in a matter in which Chomba, is charged with Assault of a Child, contrary to section 246(a) Cap 27 of the Laws of Zambia.

Aubrey Chomba , 28,  on 6th May, 2022 is alleged to have hung his son upside down to a tree in a thicket behind his house and severely beat him.

The juvenile who was rescued by community members sustained swollen legs and was unable to stand when he was untied.

Three witnesses including the juvenile testified in the matter and the prosecution proved its case beyond reasonable doubt

Both prosecution witnesses and a medical report from the hospital proved that the juvenile was assaulted.

Chomba however pleaded not guilty to the charge and in his defense said he had not beat his son and he did not know what happened to him.

In passing judgement Luanshya resident magistrate Penstone Chiluba indicated that the defendant had committed a serious offense and treated his son with maximum cruelty.

Mr  Chiluba also said that despite the child crying Chomba did not exercise mercy adding that the child would have died had not there been intervention from community members.

He however took into consideration that Chomba was a first offender and a family man and sentenced him to 72 months imprisonment with hard Labour.

Magistrate Chiluba informed Chomba that since he had pleaded not guilty to the charge he was free to appeal to the high court.
