The Kitwe High Court has sentence a-22-year old man to 15 years imprisonment with hard labour for sexually defiling a minor contrary to the Laws of Zambia.
This is a case in which Gift Banda of House no. 22663 KCC Kawama compound was facing one count of sexual defilement.
Facts of the matter are that on September 18, 2017 in Kitwe, Banda, a Marketeer at Chisokone market had unlawful carnal knowledge of a girl under the age of 16.
When delivering Judgment, Judge in Charge Timothy Katenekwa said he had taken into account that the accused is a first offender and as such he was entitled to leniency.
He said Banda acted in despicable manner by sexually assaulting a minor.
“I expected the accused to talk to girls that are of his age that can give him consent. I’ m tempted to send you to jail for a long time but looking at your age I’m assured that you will be open reform once you get out.
“I will be lenient with you and hope you will use your time to reflect on your behaviour. I sentence you to 15 years imprisonment with hard labour,” he said.
