A-38- Year-Old woman of Chingola has told the Kitwe High Court how she found herself naked in an unfinished building in a matter were Kabaso Mulenga ‘Spax’ and five others are facing the charges of murder, rape and three counts of attempted murder.
This is in a matter where Spax a small scale miner and five others are facing one count of murder, rape and three counts of attempted murder.
Sheila Bwembya told the Kitwe High Court Lady Justice Abha Patel that on the fateful day she decided to go to sleep and suddenly woke up only to find a man seated on her stomach.
When she tried to look closely, the man seated on her stomach strangled her.
Ms Bwembya said she saw another man at the door of the bedroom lighting a torch towards her while lying on the bed.
“Later I found myself in an unfinished house where I found myself totally naked, my pant thrown beside the grass and I discovered a deep wound on my palm protruding with excess blood coming out of it, I also sustained injuries in my head with a lot of blood stained on my body ,” she said.
She told the court that she was only rescued by a passerby and found herself at the hospital.
Ms Bwembya also told the court that she learnt of her son’s death two weeks after he was buried following an attack that has left her husband partially unable to hear and her other son’s eye vision impaired.
“My son Emmanuel is dead, I learnt of his death two weeks after he was buried after several attempts pressuring and insisting that I wanted to see him, my husband and the other children. I was told they were attacked by some assailants and that’s how my son died,” she said.
Ms Bwembya broke down uncontrollably forcing the court to adjourn the matter for 15 minutes to help her cool down.
When court resumed seating, it was heard that her husband was currently unable to hear properly and had lost his job while his sons right eye could not see properly as one of his veins had been cut during the attack.
Particulars of the offence are that Spax 29, Boyd Kamizhi 24, Mclean Kamizhi 22 (brothers) Gilbert Zimba 22, popularly known as Gilby and Sylvio Kwibisa 22, popularly known as Avatar and Jimmy Bwembya 23, stand charged with one count of murder and three counts of attempted murder.
In the first count the six are facing a murder charges, particulars before court are that on dates unknown but between January 22 and 23 2019 jointly and whilst acting together murdered Emmanuel Maponda.
In 2nd, 3rd, 4th, counts they are facing the charges of attempted murder that on dates unknown but between January 22 and 23 jointly and whilst acting together tried to murder three persons of the same family.
And in the 5th count on the same day they had canal knowledge of a woman without her consent.
The matter has been adjourned to August 24, for continuation of trial.
