Cop left at bay in Kazhila Jr’s case

Chiwempala Criminal Investigations Officer (CIO) yesterday told the Chingola Magistrate court that the audio was downloaded from social media but still went ahead and charged Joseph Kazhila Jr.

This is in a matter in which Kazhila Jr, the son of renowned clergy of Chingola Joseph Kazhila is charged with conduct likely to cause the breach of peace.

Wille Bwalya 44, who didnt verify which phone device was used in circulating the audio in question failed to pinpoint the gadget used in the purported crime.

Defence Counsel Tom Shamakamba of Shamakamba and Associate from Ndola yesterday had a field day with Mr Bwalya when he came up as an arresting officer.

When Mr Bwalya was asked by Mr Shamakamba weather he had evidence that the audio was circulated by Kazhila Jr. using his garget, Mr Bwalya was clueless and said it was downloaded on social media.

When he was asked if the particulars on the indictment was about circulating the voice note or conduct likely to cause breach of peace, he said the matter was about “conduct.’

“Is saying Government should be involved a crime?” he quizzed.

He said he detained and charged Kazhila Jr for making and circulation a audio on social media inciting people showing dissatisfaction in the government of the day.

Particulars of the matter before Magistrate Shadrack Chanda are that Kazhila Jr, a business executive of plot number 1722 Chikola had recorded an audio where he said chemical spray attacks were more of a spiritual battle.

The matter has been adjoined to March 16, 2020 for ruling.
