C4’s indictment amended: from rape to defilement

The indictment in which Victor Phiri popularly known as C4 was facing two counts of rape by abducting a-15-year-old girl has been amended from rape to sexual defilement.

This was after the state had applied that the case be amended accordingly considering the accused has not yet been put on defense.

Then Magistrate Mr Kalutwa Chiluba allowed the state to proceed with the witnesses.
Particulars before court are that on August, 9 and 10, last year C4 had carnal knowledge of the minor without her consent contrary to the Laws of Zambia.

The minor told the court that on August 9, 2017 she was going home from the market around 19: 00 hours when she met C4.

Later the assailant approached her with a sharp broken bottle which C4 broke in her eyes.

She said he grabbed her by the hand and threatened to stab her if she resisted.

The minor said while tagging each other another person known to her passed by but was bribed by C4 with K50 and he left.

“He was still holding me by my hand with the bottle in his hand threating me when he took me to Lulamba to his apartment where he had sex with her.

James Mwaba the second witness said on the fateful day he saw C4 struggling with the minor who asked help from him

But after he tried C4 took his phone and later gave him his phone and a K50 and said he is taking minor his home.

And Josephine Kolala the third witnessed also testified what transpired on the August 9 and August 10 2017 how her daughter never returned home.

Magistrate Mr Chiluba adjourned the matter to July 6, 2018 for continuous of trail.
