C4 convicted amid tight security

Chingola Magistrate Court has convicted and committed Victor Phiri popularly known as C4 to the Kitwe High Court for sentencing for two counts of sexual defilement.

This is in a case in which C4 20, was facing two counts of sexual defilement.

His Jerabo friends from Kitwe trooped Chingola to offer solidarity but security was uncompromisable.

The friends were fished out from court room which was parked by armed officers and pushed out to outside court yard.

Particulars before court were that on August 9, and 10, last year C4 had carnal knowledge of the minor without her consent contrary to the Laws of Zambia.

When the matter came up for plea, C4 pleaded not guilty to the charge but when he was put on his defense he told the court that the minor was his girlfriend and she told him she was 17 years old.

He also told the court that he had sex with the minor six times but with her consent.

He accused the minor of changing her mind because her mother wanted to fix him (C4) because of the rivalry in the pit between his group and her mother’s group.

In delivering his Judgment Magistrate Kalutwe Chiluba said that he was satisfied with the evidence presented by the state and convicted C4 with two counts of defilement.

Mr Chiluba said that the evidence had proved that the minor was under the age of 16 and the medical report shows that the minor was sexually defiled.

He said the accused himself told the court that he had canal knowledge of  her six times and this evidence collaborates with the minor’s evidence.

“It is not in dispute that the minor and the accused had consented sex but age in the case of defilement is an essential and crucial.

“In collaboration with the evidence before court the minor was a child and the accused was not married to her but whether she was his girlfriend or not the minor was defiled therefore I find you guilty of both counts and convicts you accordingly,” he said.

C4 is also facing two counts of murder charges in the Kitwe High Court with three others.
