C4, 3 others committed to High Court for murder

Chingola Magistrate Court has committed Victor Phiri popularly known as C4 and three others to Kitwe High Court for trial.

C4 20, his elder brother Martin Phiri 21, popularly known as Martinego, John Mulenga 21, also known as John KG and a juvenile were appearing before the Chingola Magistrate Kalutwe Chiluba for mention.

This is in a case where C4 and three other persons are charged with one counts of murder and one count of attempted murder contrary to the Laws of Zambia.

Particulars before court are that in the first count the quartet on May 21, this year, C4 and his gang jointly and whilst acting together did murder Musonda Makumba.

On count two the quartet are charged with the offence of attempted murder, particulars before count are that on May 27, this year jointly whilst acting together with other persons unknown unlawfully caused the death of Aaron Kanduli.

Magistrate Mr Chiluba told the quartet that having seen the committal certificate issued by the Director of Public Prosecution (DPP) certifying that this is a proper case for trail by high count.

He said according to section 254 of the criminal procedure code chapter 88 of the Laws of Zambia as read with statutory instrument No 235 of 1965 commits the accused persons to the High Court for trail.

Meanwhile C4 has been found with the case to answer in the case where he is facing two counts of sexual defilement and he has been put on his defense.

But he has acquitted on assault charges.
