The Chingola Magistrate court has found sexual defiler guilty and has committed him to the High Court for sentencing.
Enock Kapenda 27, of Soweto has been committed to the High Court sexually defiling his 15-year old step daughter and impregnating her.
Kapenda, a Security Guard is facing one count of defilement contrary to the Laws of Zambia.
Resident Magistrate Stephen Mabona in passing Judgment said that the persecution had proven the case beyond reasonable doubt that the victim is 15 years old, and that the medical report shows that her hymen was torn.
Mr Mabona also said that it was not in dispute that the girl was six months pregnant.
He also said that according to the victim she told the court that on dates unknown her father went to her bedroom in the night and when she saw him he run away and on another day he came to her room and threatened to kill her and her mother if she refused to have sex.
“She also said that you did the same on another day and that she didn’t tell her mother because she was scared and that she was not aware that she was pregnant until her mother’s friend asked her,” he said.
Mr Mabona also said that the convict was denying but at some point in his testimony agreed that he had sex with her twice but not at their house as the girl was saying.
He also Kapenda during cross examination admitted to the mother of the victim of having carnal of the girl.
Magistrate Mabona in passing Judgment said that all evidence shows that Kapenda defiled the victim and convicted him accordingly.
In mitigation Kapenda told that court that he was the bread winner of his family and that the same pregnant girl will have no one to buy food and clothes for the child.
Particulars of the offence are that Kapenda on dates unknown but between February and February 28, 2020 unlawfully had cancel knowledge of the girl under the age of 16.
