In an effort to streamline the disposal of offences under the Local Government Act No. 2 of 2019, the Chingola Municipal Council has launched a fast-track court.
The official launch was graced by Justice Charles Chanda, who emphasised that the new court would play a crucial role in alleviating the congestion faced by traditional Magistrates courts.
Justice Chanda, presiding over the launch ceremony, highlighted that the fast-track court would function as a first-class court, possessing jurisdiction and powers as provided by the Subordinate Court Act, Chapter 28. Notably, this specialized court would focus primarily on offences under the Local Government Act No. 2 of 2019 and other relevant legislation specifically pertaining to Chingola.
Contrary to misconceptions, Justice Chanda clarified that the establishment of the fast-track court was not intended to impose punitive measures on offenders. Instead, its main purpose is to ensure strict adherence to applicable laws, particularly those related to business conduct, street vending, public nuisance management, waste disposal, unauthorized building, and expediting the resolution of cases for those found in violation.
The fast-track court, in accordance with Section 25 of the Subordinate Court Act, Chapter 27 of the Laws of Zambia, can be held at any location directed by the Chief Justice. Furthermore, Section 10 of the same act provides the flexibility for the sitting of the subordinate court in various buildings within Zambia as assigned by the Chief Justice.
And Chingola Mayor Johnson Kang’ombe expressed optimism about the collaborative efforts towards improving access to justice and fostering a robust partnership in the region.
He also noted that the launch of the fast-track court was timely, especially as Chingola is striving to attain city status.
Meanwhile, Chingola District Commissioner, Raphael Chimupi, shared his views on the positive impact of the court’s introduction. He believes that it will inspire a shift in mindset among the populace, encouraging them to conduct themselves in compliance with the established legal provisions.
The launch of the fast-track court by the Chingola Municipal Council marks a significant step towards expediting the resolution of offences and upholding the rule of law in the region. The specialised court will focus on Local Government Act violations and related legislation, while also promoting a sense of responsibility and adherence to the law within the community.
