The Chingola Magistrate Court has sentenced Brian Lubumbe and four others to three months and one month imprisonment respectively for criminal trespass.
This is in a matter in which the five have been dragged to count for criminal trespass on three farm plots of Chingola District Veterinary Officer Emmanuel Chitambala.
Particulars of the offence are that Brian Lubumbe 60, Crispin Simukonda 46, Juma Banda 29, Layment Chisenga 64, and Asafu Banda 47, between December 1, 2019 and June 6, 2020 willfully but unlawfully entered the property of Dr Chitambala therein to commit a felony.
In passing judgement Resident Magistrate Stephen Mabona said that the five had no right to be on that land as it was on title under Dr Chitambala as the rightful owner.
During mitigation Lubumbe rudely responded to the court that he would not give any mitigation.
And in compensating the remorseful ones, Magistrate Mr Mabona said he would accord maximum lenience to the three convicts who had shown remorse for what they had.
The trio Simukonda, Juma and Chisenga were then sentenced to for 30 days each while Lubumbe and Banda got three months imprisonment with hard labour because they didn’t regret what they did.
