Charles Kabwita acquitted

The Kitwe Magistrate Court has acquitted the National Democratic Congress (NDC) National Youth Chairperson Charles Kabwita on one charge of conduct likely to cause breach of peace.

This was after the Stephen Kampyongo led team made up flimsy allegations to have Mr Kabwita arrested and later prosecuted.

Particulars of the offence are that on February 24, this year Mr Kabwita 37, while at Fremos Bar and Restaurant were some cabinet ministers where having lunch among them Freedom Sikazwe and Stephen Kampyongo did conduct himself publicly in a manner likely to cause the breach of peace contrary to Laws of Zambia.

During trial Mr Kabwita pleaded not guilty to the charge while the prosecution called four witnesses which included the arresting officer from the Zambia Police.

When passing a ruling in Kitwe this morning, Chief Resident Magistrate Yvonne Nalomba said the prosecution had failed to prove a case of prima facie against Mr Kabwita according to the evidence before the court to find him with a case to answer.

Magistrate Ms Nalomba said it is with this in mind that she evoked the provisions of section 206 of the criminal procedure court and found the accused with no case to answer.
