The last two boys that are alleged to belong to the infamous Tokota gang gave their defense yesterday in the Kitwe Hugh Court.
Hills Mwamba 28, of Ndeke Township and Trust Sinkala 20, of Mulenga over spill are jointly charged with 17 others in a case in which they are facing three counts.
The two are among the 17 boys alleged to be members of the Tokota gang that abducted, wounded and unlawfully poisoned Cathdeck Nkonde on April 30, 2018 in Kitwe.
Appearing before Judge in Charge Timothy Katenekwa yesterday in a session that took more than 6hours, Mwamba told the court that he was in Kwacha on April 30, 2018 visiting his newly born baby and his mother.
Mwaba narrated that he was picked up around 12 hours from his home by the Community Crime Prevention Unit Officers who informed him that he had assaulted a Congolese national but he was shocked that he was taken to Kitwe Central Police station for the offenses he was appearing in court for.
He narrated that the arresting officer Mujuku refused to include his whereabouts on the material day in the warn and caution statement as he was not on the scene.
And Trust Sinkala told the court that on the material day of the attack he was with his father painting the house an exercise that ended on May 9, 2018.
He told the court that when he finished painting the house he was not feeling well because of stretching his arm during painting.
Sinkala narrated that he was apprehended by the police on his way to the clinic at Kamfinsa bus station as he was waiting for a bus to Mulenga.
The 17 where apprehended after a video circulated on social media where a young man was forced to eat his feaces prompting public outcry.
Allegations are that on April 30, 2018 in Kitwe the accused persons, jointly and whilst acting together with intent to maim, injure or disfigure did cause grievous harm to Cathdeck Nkonde a resident of Kitwe.
And in Count Two, the 18 accused persons are charged with unlawful wounding and poisoning contrary to the laws of Zambia.
Allegations are that on April 30, 2018 in Kitwe, jointly and whilst acting together with intent to injure or annoy, all 19 accused persons caused Cathdeck to eat feacal matter.
In count three, the accused persons are charged with Kidnapping or abducting in order to subject a person to grievous harm contrary to the laws of Zambia.
Allegations are that on April 30, 2018 in Kitwe, jointly and whilst acting together all 19 kidnapped Cathdeck Nkonde in order to put him in danger and to subject him to grievous harm.
